If the 9th Circuit does declare it unconstitutional, I wonder how long it will take the Supreme Court to grant cert. Will they even wait for the petition or just do it sua sponte? As you can see, I don't have much hope.

I'm sure some aspects of the law have already been challenged before SCOTUS. I find it hard to believe that this is the first time that AEDPA is being looked at in a constitutional context.

That having been said, I'd like to see some of it's more restrictive provisions regarding Habeas petitions lifted, but that's not going to happen. Not by a long shot.
